What is Proposition 65?

Proposition 65 is designed to protect consumers from excessive exposure to chemical carcinogens and other toxins in their environment, drinking water and the products they purchase. 

To achieve this, the State of California publishes and maintains a list of chemicals known to cause cancer, birth defects and/or reproductive harm to consumers. Today, the list includes some 100 chemicals found in pesticides, food, drugs, solvents and a range of common household products, along with many chemicals used or discharged by the manufacturing and construction industries.

What does Proposition 65 mean for companies?

Proposition 65 requires companies producing goods containing ‘listed’ chemicals in quantities above the safe harbor level to disclose this to consumers by providing ‘clear and reasonable warning’. It also prohibits companies from knowingly discharging listed chemicals into the state’s drinking water resources.
